Play fair.
These terms govern use of utomnia.studio. By using the website, you agree to them. If you do not agree, please do not use the website.
About us
The website is operated by Utomnia Limited, registered in England and Wales under company number 09085136. Registered office: 20 Lloyd Drive, Kemsley, Sittingbourne, Kent, ME10 2GA. You can contact UTOMNIA using our secure form.
Store and ordering
The website provides publisher and game information and allows eligible customers to buy selected games and in-game digital content. An item is available to order only when a working purchase button and confirmed GBP price are shown. The product page describes the content, compatibility and any material restrictions. The total price and payment obligation are shown before you place the order.
Your order is an offer to buy. A contract is formed when we accept payment and confirm the order. Payment is processed by Stripe; UTOMNIA does not store your full card details. We may decline or cancel an order before supply where reasonably necessary, including for an obvious pricing error, suspected fraud, lack of stock or inability to supply, and will refund any amount taken for an order we cancel.
Digital content, cancellation and refunds
Character codes, downloadable games and other in-game items are digital content. Where immediate supply is available, checkout asks you to expressly consent to supply beginning immediately and to acknowledge that your 14-day cancellation right will end once supply begins. Supply begins when the code or content is made available in your account or sent to you after successful payment.
Once supply has begun with that consent and acknowledgement, we do not normally provide a change-of-mind refund. This does not affect your statutory rights where digital content is faulty, not as described or not supplied. Our cancellation and refund policy explains this process.
Character codes and licences
A purchase grants the customer a personal, limited right to use the digital content with the relevant game, subject to the game’s applicable licence and rules. Character codes should be kept private. A purchaser may give an unused code to another person where the product page permits gifting, but must not sell codes commercially, publish them, obtain them fraudulently or attempt to redeem the same code more than once.
Your account
You must provide accurate information, keep your sign-in details secure and tell us promptly if you suspect unauthorised use. You are responsible for activity through your account unless caused by our failure to use reasonable care. Accounts may not be sold or transferred, and character codes must not be shared publicly or used fraudulently. An unused code may be given as a gift where the product page permits it. We may restrict an account where reasonably necessary for security, fraud prevention or a material breach, and will act proportionately.
Using the website
You may access the public website for lawful personal or business information purposes. You must not:
- break any applicable law or infringe another person’s rights;
- attempt to bypass security, access a restricted area without permission, introduce malicious code, or disrupt the website;
- scrape, copy or use the website at a scale that harms the service or unreasonably burdens its infrastructure; or
- misrepresent an affiliation with Utomnia Limited, its developers or games.
Intellectual property
Unless stated otherwise, the website and its content are owned by or licensed to Utomnia Limited and protected by intellectual property law. PaperGoblin, Floor Drop and third-party names, artwork and marks remain the property of their respective owners. You may view and make a temporary copy necessary for normal browsing, but may not reproduce, distribute, modify, commercially exploit or create derivative works from the content without the relevant owner’s permission.
Accuracy and availability
Games in development can change. Alpha status, features, platforms, release windows and availability are informational and not guarantees. We may update, suspend or withdraw any part of the website. We aim to keep information useful and the service available but do not promise uninterrupted or error-free access.
Links and third-party services
Links to developer sites, Twitch, social platforms and future storefronts are provided for convenience. We do not control and are not responsible for their content, availability, security or privacy practices. A link does not necessarily imply endorsement.
Our responsibility
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights. Subject to that, if you use the website for business purposes, we are not liable for loss of profit, revenue, business, opportunity, anticipated savings, data or goodwill, or for indirect or consequential loss arising from use of the informational website.
Law and disputes
These terms are governed by the law of England and Wales. If you are a consumer, you keep any mandatory protections and may bring proceedings in the courts available to you under applicable law. Otherwise, the courts of England and Wales have exclusive jurisdiction.
